Please review our policies carefully before renting a motorcycle. These policies are designed to ensure a smooth and enjoyable experience for all our customers.

1. Rental Agreement

By renting a motorcycle from Himalayan Rentals, you agree to the following terms and conditions. This agreement is between you (the "Renter") and Himalayan Rentals (the "Company").

2. Eligibility Requirements

To rent a motorcycle, you must:

  • Be at least 21 years of age
  • Possess a valid motorcycle driving license
  • Provide a valid government-issued ID (Aadhar, PAN, Passport, or Voter ID)
  • International travelers must have a valid International Driving Permit along with their passport

3. Security Deposit

A refundable security deposit of ₹5,000 is required for all rentals. This deposit will be returned within 48 hours of the motorcycle being returned in the same condition as when it was rented, minus any necessary fuel top-ups or damage deductibles.

4. Rental Period

The rental period begins at the time of pickup and ends at the agreed-upon return time. Late returns may incur additional charges at our standard daily rate.

5. Motorcycle Use

The motorcycle must only be used:

  • On public roads and highways
  • In accordance with all traffic laws and regulations
  • By the person named in the rental agreement
  • Within the geographical boundaries specified at the time of rental

The motorcycle must NOT be used:

  • For any illegal purpose
  • For racing or speed testing
  • To transport goods for commercial purposes
  • While under the influence of alcohol or drugs
  • In restricted areas without proper permits

6. Maintenance and Damages

The Renter is responsible for:

  • Checking fuel and tire pressure regularly during extended rentals
  • Reporting any mechanical issues immediately
  • Returning the motorcycle with the same fuel level as at pickup
  • Any damages caused during the rental period, up to the amount of the insurance deductible

7. Insurance

Basic insurance is included in the rental price. This covers third-party liability and basic damage to the motorcycle, subject to a deductible. The Renter is responsible for any damages up to the deductible amount.

8. Accidents and Theft

In case of an accident or theft:

  • Contact us immediately at +91-97-17-37-57-67
  • File a police report (FIR) if required
  • Do not admit liability or make any offers to third parties
  • Collect details of any third parties and witnesses involved

9. Limitation of Liability

We strive to provide safe, well-maintained motorcycles, but riding involves inherent risks. Here's what you should know about our liability:

  • We are not responsible for injuries, accidents, or damages that occur during your rental period unless directly caused by a mechanical failure beyond what our comprehensive insurance covers
  • We are not liable for lost time, travel expenses, or other costs for motorcycle break-downs or accidents during your rental
  • Our maximum liability is limited to the amount you paid for the rental
  • We are not responsible for personal belongings left in or attached to the motorcycle

This limitation of liability does not affect your statutory rights as a consumer or our obligations under Indian consumer protection laws.

10. Third-Party Services

During your rental experience, you may use or encounter third-party services related to your motorcycle rental:

  • Payment Processors: We use secure third-party payment systems. While we carefully select these providers, we are not responsible for their data practices beyond ensuring they meet basic security standards
  • Insurance Providers: The insurance included with your rental is provided by third-party insurers. Claims must be processed according to their terms and conditions
  • Roadside Assistance: If provided, roadside assistance services are delivered by third-party providers whose availability and response times we cannot guarantee
  • Recommended Routes and Destinations: Any routes, attractions, or accommodations we recommend are suggestions only. We are not affiliated with these businesses unless explicitly stated

While we make every effort to partner with reliable service providers, we cannot be held responsible for the quality, availability, or safety of services provided by these third parties.

11. Termination

The Company reserves the right to terminate the rental agreement and take possession of the motorcycle at any time if the Renter violates any terms of this agreement.

12. Governing Law

This agreement is governed by the laws of India. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in West Bengal, India. By entering into this rental agreement, you consent to this jurisdiction and venue for any legal proceedings related to your motorcycle rental.
